2. Warnings and Assumption of Risk

  • Dangers of Kiteboarding: Kiteboarding is dangerous. Be sure to receive professional training and always exercise extreme caution. Use this product only if you are in good physical and mental condition. Use an appropriate kite size for your skill level and wind conditions, as gusts can be life-threatening. Never kiteboard in offshore or onshore winds or in downwind areas with obstacles. Turbo fins are not suitable for shallow water, reefs, or seaweed.

  • Assumption of Risk: The use of WAY Watersport products involves the risk of injury or death for you and others. By using this product, you agree to accept all known and unknown risks. Following the warnings and using the product carefully can reduce these dangers but cannot completely eliminate them.

3. Safety Guidelines for Use

  • Wind and Water Conditions: Avoid kiteboarding in adverse wind conditions, and keep the water clear of obstacles such as seaweed or debris. Turbo fins are designed for use in deep, clear water.

  • Physical Precautions: Never insert body parts into the fins to avoid injury. Start with light wind conditions to familiarize yourself with the new handling characteristics of WAY Watersport fins.

4. Liability Disclaimer and Waiver of Claims

  • Reading Requirement and User Awareness: You confirm that you have read and understood all instructions and warnings in the user manual. You are also responsible for ensuring that other people using the product are informed of all risks and instructions.

  • Liability Disclaimer: By purchasing and using the WAY Watersport product, you waive all future claims against WAY Watersport and its partners for damages or injuries resulting from the use of the product. This waiver of liability applies, to the extent permitted by law, to your heirs and successors.

5. Warranty Conditions

  • Scope of Warranty: WAY Watersport provides a warranty against material and workmanship defects to first-time buyers for six months from the date of purchase. The warranty covers damages caused solely by material or manufacturing defects and includes repair or replacement.

  • Warranty Terms: The warranty is non-transferable and does not apply to rental or training products. It is only valid if the product has been used exclusively in water. Warranty claims require product registration on our website and proof of purchase.

  • Exclusions and Misuse: Damage caused by misuse, improper handling, normal wear, excessive sun exposure, or incorrect mounting or attachment is excluded from the warranty. Any alterations to the product without WAY Watersport's approval will void the warranty.

6. Special Notes on Shape and Potential Damage to Other Equipment

  • Distinct Shape and Precautions: The WAY Watersport fins have a tapered shape for optimized performance. Due to this shape, special care should be taken to avoid accidental damage to other equipment such as kites, lines, or boards. When storing, transporting, and setting up the fins, ensure that they do not come into contact with delicate materials.

  • Liability Disclaimer for Consequential Damages: WAY Watersport assumes no liability for damage to other equipment caused by contact with the fins. Users are responsible for careful handling.

7. Storage, Maintenance, and Liability Disclaimer for Modifications

  • Proper Storage and Transport: Always store, transport, and handle the fins carefully. Avoid placing other items on top of the fins to prevent damage, and protect them from direct sunlight and heat, as these can weaken the material.

  • Mounting Conditions and Regular Inspection: Ensure that the fins and all related components are free from sand and debris before mounting them to guarantee secure attachment. Regularly inspect the fins for any damage or wear, and do not use damaged fins.

  • Liability Disclaimer for Modifications: Any independently performed modifications or repairs to the WAY Watersport fins will void the warranty and liability. WAY Watersport is not liable for damages or accidents resulting from unauthorized changes to the product.
